1. Purpose, Vision, Objectives & Operational Scope
The Legal Cell of DMJCCA is established to provide legal awareness, guidance, documentation assistance, and, where appropriate, legal support to members in matters connected with journalism, digital media, and content creation. It functions under the authority of the National Executive Council (NEC) and applicable laws. The Legal Cell is not a law firm and does not guarantee legal representation in every matter.
Vision: To create a legally aware, professionally protected, and ethically responsible digital media community across India.
Core Objectives: Promote legal awareness, protect members’ professional rights, provide preliminary guidance, assist in legal documentation, build an advocate panel, conduct legal workshops, monitor media law developments, support ethical journalism, and encourage lawful digital publishing.
Operational Scope: Journalism, Digital Media, Social Media, Content Creation, Copyright, Trademark, Defamation, Cyber Law, Privacy, IT Act, Media Ethics, Contracts, and Consumer Issues related to media work. Personal disputes unrelated to professional media activities are not ordinarily handled.
2. Organizational Hierarchy & Legal Advisory Board
- Legal Advisory Board Composition: Senior Advocates, High Court Advocates, Supreme Court Advocates, Corporate Lawyers, Cyber Law Experts, Intellectual Property Experts, Media Law Experts, and Legal Academicians.
- Appointment Criteria: Professional qualifications, verified legal experience, personal integrity, Bar Council Enrollment (where applicable), and formal approval by the National Executive Council.
3. Functions, Categorized Services & Case Eligibility
The Legal Cell reviews complaints, verifies facts, maintains records, drafts notices, reviews agreements, conducts awareness sessions, coordinates with panel advocates, prepares reports, and recommends legal proceedings.

Eligible Matter Types: Journalism, reporting, digital content, copyright infringement, defamation, cyber harassment, online abuse, illegal content removal, professional threats, media access issues, and media contracts.
4. Case Lifecycle, Approval Authority & Emergency Support
- Case Registration: Members submit a formal Legal Assistance Application, Membership Number, Identity Proof, Relevant Documents, Brief Facts, Supporting Evidence, and Contact Details. A unique Legal Case Number is assigned.
- Verification & Opinions: The Cell reviews active membership, identity, facts, jurisdiction, conflict of interest, and prima facie merit. Written legal opinions are advisory and do not represent judicial determinations. False submissions result in case rejection and disciplinary proceedings.

Chapter 16: Emergency Legal Assistance
In critical situations arising directly from professional duties (such as arrest, unlawful detention, equipment seizure, or physical threats), the Legal Cell provides immediate guidance, contacts local panel advocates, coordinates with authorized family members, and escalates to senior leadership subject to legal merit.
5. Education, Registers, Ethics & Financial Policy
- Legal Awareness Programmes: Conducts Media Law Workshops, Cyber Law Sessions, Copyright Awareness, RTI Training, Digital Rights Seminars, Fact-Checking Workshops, Defamation Law Sessions, and Privacy/Data Protection Clinics.
- Mandatory Registers: Secure physical/digital custody of Case Register, Notice Register, Opinion Register, Advocate Panel Register, Court Matter Register, Mediation Register, and Closed Case Register.
- Confidentiality & Conflict: All information is confidential and disclosable only upon consent, legal requirement, internal case handling, or court order. Legal officers must recuse themselves from matters involving personal ties, adverse representation, or financial bias.
- Member Responsibilities: Members must submit truthful information, cooperate fully, follow legal advice responsibly, maintain confidentiality, and update the Cell regarding any developments.
- Financial Policy: Legal support does not automatically cover Court Fees, Advocate Fees, Filing Charges, Travel Expenses, or Documentation Costs. Financial relief is exceptional, strictly subject to prior NEC approval and fund availability.
6. Reporting Cycles, Risk Audits & Advocate Panel Rules
Statutory Reporting: The National Legal Cell compiles Monthly, Quarterly, and Annual Reports covering cases received/resolved, pending litigations, awareness seminars, and regulatory recommendations.
Legal Risk Management: Conducts systematic audits of institutional compliance, standard contracts/MoUs, privacy/data policies, IP assets, and defamation exposures for the National Executive Council.
Disciplinary Sanctions: Submitting forged evidence, misusing legal aid, filing frivolous suits, concealing material facts, or abusing the Association’s banner will trigger disciplinary inquiries, membership revocation, and legal action.
Panel Advocate Policy: Empaneled advocates must hold active Bar Council enrollment, media/cyber/constitutional expertise, execute confidentiality undertakings, and practice independently. Empanelment does not constitute an employer-employee relationship.

“I certify that the information and documents provided by me are true and complete to the best of my knowledge. I understand that any legal guidance or support provided by DMJCCA is subject to verification, the merits of the case, applicable law, availability of resources, and approval by the competent authority. I further understand that the Association does not guarantee legal representation or any specific legal outcome.”
Final Administrative Declaration
This Legal Cell SOP establishes the governance, procedures, and standards for the Legal Cell of DMJCCA. It shall be read together with the Constitution, Memorandum of Association, Bylaws, Membership Rule Book, Election Rule Book, HR & Administrative Manual, and other approved policies. Any amendment to this SOP shall require approval by the National Executive Council and shall remain consistent with applicable law and the Constitution of the Association.
