DMJCCA is committed to promoting professional development, responsible digital media practices, networking, awareness, recognition and welfare of digital journalists, content creators and other digital media professionals.

This Disclaimer & Grievance Redressal Policy explains the nature of information available through DMJCCA, the independence and responsibility of members, and the procedure for submitting grievances or complaints relating to the Association or content associated with its verified members.

 

  1. General Disclaimer

1.1. The information published on www.dmjcca.com is provided for general informational, educational, professional, community and welfare purposes.

1.2. DMJCCA makes reasonable efforts to ensure that information published through its official website and official communication channels is accurate and updated. However, DMJCCA does not warrant that every piece of information will always be complete, current, error-free or suitable for a particular purpose.

1.3. Information relating to members, portfolios, professional profiles, external publications, social-media accounts, organizations, businesses, events or third-party services may be based on information supplied by members or external sources.

1.4. DMJCCA does not guarantee the accuracy, authenticity, legality, availability or reliability of information contained on third-party websites, social-media platforms or external links.

1.5. Users are advised to independently verify important information before relying upon it for legal, financial, commercial, professional or other consequential purposes.

 

  1. Nature and Role of DMJCCA

2.1. DMJCCA is a professional/community association intended to bring together digital journalists, content creators, YouTubers, bloggers, podcasters, social-media creators, reporters, video journalists, media students, freelancers and other digital media professionals.

2.2. Membership or association with DMJCCA should not automatically be interpreted as:

  • Government employment;
  • Government accreditation;
  • Government authorization;
  • statutory press accreditation;
  • a licence to practise journalism;
  • an endorsement of every publication or opinion of a member; or
  • a guarantee of employment, income, brand collaboration or professional assignment.

2.3. Any membership card, digital ID, certificate, recognition or other document issued by DMJCCA represents association membership or recognition according to the applicable terms of the Association and should not be represented as a government-issued document unless specifically stated otherwise.

 

  1. Editorial & Content Independence

3.1. DMJCCA respects the editorial and creative independence of its members.

3.2. Articles, reports, videos, podcasts, reels, social-media posts, broadcasts, interviews, opinions and other content independently created or published by members on their own platforms do not necessarily represent the official views, policies or editorial position of DMJCCA.

3.3. Individual members remain responsible for the content they create, publish, broadcast, distribute or otherwise communicate through their own platforms.

3.4. Membership in DMJCCA does not transfer editorial responsibility for a member’s independent publication to the Association.

3.5. DMJCCA does not ordinarily exercise prior editorial control or pre-publication censorship over independently produced member content.

3.6. Where DMJCCA itself publishes or distributes content through its official channels, such content may be subject to the Association’s own editorial, legal and administrative policies.

 

  1. Member Responsibility

Members are expected to comply with applicable laws and maintain responsible professional conduct.

Members should not use their DMJCCA membership, name, logo, ID or association with DMJCCA to:

  • falsely claim government authority or accreditation;
  • impersonate another person or organization;
  • misrepresent their professional status;
  • publish knowingly false or misleading information;
  • infringe copyright, trademark or other intellectual-property rights;
  • violate privacy or confidentiality;
  • engage in harassment, threats or unlawful discrimination;
  • facilitate fraud, financial scams or other unlawful activities;
  • misuse the DMJCCA name, logo or identity; or
  • undertake any activity that may unlawfully damage the reputation of another person or organization.

Where appropriate, DMJCCA may review complaints concerning misuse of its name, identity, membership credentials or other Association resources.

 

  1. Third-Party Links and External Platforms

5.1. The DMJCCA website or official communication channels may contain links to third-party websites, social-media platforms, videos, publications, services or other resources.

5.2. Such links are provided for convenience and informational purposes.

5.3. DMJCCA does not necessarily endorse, control or guarantee the content, availability, security, privacy practices or services of third-party platforms.

5.4. Users should review the terms, privacy policies and other applicable policies of third-party websites before using them.

 

  1. Intellectual Property

6.1. Unless otherwise stated, the DMJCCA name, logo, branding, website design, original graphics, text, documents and other original materials created by or for DMJCCA may be protected by applicable intellectual-property laws.

6.2. No person may reproduce, modify, distribute, commercially exploit or use DMJCCA branding in a manner that falsely suggests official authorization, sponsorship or endorsement.

6.3. Members and third parties must ensure that material submitted to DMJCCA does not knowingly infringe the copyright, trademark, privacy, publicity or other rights of another person or organization.

6.4. DMJCCA may remove or restrict access to material where it receives a credible complaint or otherwise becomes aware of an apparent legal or policy violation, subject to applicable law and due process.

 

  1. Grievance Redressal Mechanism

DMJCCA maintains an internal grievance mechanism for receiving and reviewing complaints concerning:

  • official DMJCCA activities;
  • the misuse of DMJCCA’s name, logo or membership credentials;
  • conduct of members in connection with their association with DMJCCA;
  • information published through official DMJCCA channels; and
  • other matters falling within the Association’s administrative or professional mandate.

Where a complaint concerns content independently published by a member on a personal website, YouTube channel, social-media account or independent news platform, DMJCCA may review the matter to the extent that it concerns the Association, its membership, its branding or applicable Association policies. The Association does not automatically assume editorial or legal responsibility for such independent content.

 

  1. Who Can File a Grievance?

A grievance may be submitted by:

  • an individual;
  • a member of DMJCCA;
  • a non-member;
  • an organization;
  • a public institution or body; or
  • another person or entity having a legitimate concern.

Complaints should be made in good faith and should contain sufficient information for the matter to be reviewed.

 

  1. Complaint Filing Procedure

A grievance should preferably be submitted by email to the designated Grievance Redressal Officer.

The complaint should contain, wherever applicable:

  1. Full name of the complainant;
  2. Contact email and/or telephone number;
  3. Organization or professional affiliation, if relevant;
  4. URL/link to the disputed content;
  5. Date of publication or occurrence;
  6. Name or identification of the concerned member, account or platform;
  7. Specific grounds of complaint;
  8. Relevant screenshots or supporting documents;
  9. Explanation of the relief or corrective action requested; and
  10. Any other information necessary for proper examination of the complaint.

Incomplete, anonymous or unverifiable complaints may be difficult to process. However, DMJCCA may consider serious complaints involving public safety, unlawful conduct, fraud, impersonation or other significant concerns even where complete complainant information is unavailable, subject to applicable law and practical verification.

 

  1. Acknowledgement and Review

DMJCCA will make reasonable efforts to acknowledge a properly submitted grievance promptly.

Where the grievance mechanism is being operated under an applicable statutory or regulatory framework, the applicable statutory timelines will be followed.

For grievances falling within the applicable publisher grievance framework under the IT Rules, 2021, the relevant framework provides for acknowledgement within 24 hours and communication of the decision within 15 days.

For other internal Association matters, DMJCCA may require additional time depending upon the complexity, availability of records, requirement for clarification and nature of the complaint.

 

  1. Investigation and Corrective Action

Depending upon the nature of the grievance, DMJCCA may:

  • seek additional information from the complainant;
  • request clarification from the concerned member;
  • examine publicly available information;
  • review relevant Association records;
  • issue an advisory or warning;
  • request voluntary correction or clarification;
  • suspend or restrict Association privileges where permitted under Association rules;
  • withdraw or cancel membership-related recognition where justified;
  • remove Association-controlled content where appropriate; or
  • refer the matter to an appropriate authority where required by law.

DMJCCA does not have jurisdiction to adjudicate disputes that legally fall within the authority of courts, statutory regulators, law-enforcement agencies or other competent authorities.

 

  1. False, Malicious or Abusive Complaints

DMJCCA expects grievances to be submitted honestly and responsibly.

Complaints containing knowingly false allegations, fabricated evidence, impersonation, threats, harassment or abusive material may be rejected or otherwise dealt with in accordance with applicable law and Association policy.

This provision does not restrict a person’s legitimate right to raise a genuine grievance or seek remedies available under law.

 

  1. Privacy and Confidentiality of Complaints

13.1. Personal information submitted as part of a grievance will be used primarily for processing, investigating and responding to the complaint and for maintaining necessary records.

13.2. DMJCCA will make reasonable efforts to protect grievance-related information from unauthorized disclosure.

13.3. However, information may be disclosed where required by law, court order, government authority, law-enforcement agency, regulatory requirement, or where disclosure is reasonably necessary for investigation or resolution of the grievance.

13.4. Complainants should avoid submitting unnecessary sensitive personal information.

 

  1. Emergency and Serious Legal Matters

Complaints involving immediate threats to life or safety, serious criminal conduct, child safety, terrorism, financial fraud or other matters requiring urgent governmental or law-enforcement intervention should also be reported directly to the appropriate competent authority.

DMJCCA’s grievance mechanism is not a substitute for emergency services, police complaints, court proceedings or statutory remedies.

 

  1. Limitation of Responsibility for Independent Member Content

DMJCCA is an association/community platform and does not automatically become the publisher, editor, author or legal representative of content independently created by its members.

The concerned member, creator, journalist, publisher or platform operator remains responsible for content published through their independent channels, subject to applicable law.

DMJCCA may nevertheless take appropriate internal action where a member’s conduct involves misuse of Association identity, violation of membership terms, false representation of the Association or other matters within DMJCCA’s legitimate administrative authority.

 

  1. No Guarantee of Professional Outcomes

DMJCCA may provide networking opportunities, training, certification, recognition, community access, professional awareness, creator collaboration opportunities, events and other initiatives.

However, DMJCCA does not guarantee:

  • employment;
  • income;
  • business contracts;
  • brand collaborations;
  • media assignments;
  • audience growth;
  • social-media verification;
  • government accreditation;
  • press access;
  • awards; or
  • any particular professional outcome.

Opportunities may be subject to eligibility, availability, independent selection and applicable terms.

 

  1. Policy Updates

DMJCCA may update, modify or revise this Disclaimer & Grievance Redressal Policy from time to time to reflect changes in:

  • applicable laws and regulations;
  • Association policies;
  • digital-media practices;
  • technology;
  • grievance procedures; or
  • organizational requirements.

The updated version will be published on www.dcjcca.com with the revised effective or update date.

 

  1. Governing Law and Jurisdiction

This policy shall be interpreted in accordance with the laws applicable in India.

Nothing in this policy shall prevent any person from exercising a legal right or remedy available under applicable Indian law before a competent authority, tribunal or court.

Jurisdiction: Subject to applicable law, disputes relating to the Association and matters within its administrative control shall be subject to the jurisdiction of the competent courts/authorities at Mumbai, India.
